‘Tis the Season of Celebration!

tis the season of celebration

And while we welcome joyous reunions, happy feasting, and celebratory toasts, it also means more alcohol-related incidents on the roads. Law enforcement steps up their patrols over the holidays.

If your holiday is ruined by a DUI, our office is here to help you get started building your defense, even in a particularly busy and stressful time of year. So, what should you do if you are arrested this holiday season?

Try to stay calm.

Police stops can be scary for most people. And sometimes fear makes us do unreasonable things. Before the officer reaches your vehicle, or before you give the officer any sort of verbal response, take a deep breath and calm your mind as best you can. You want to be sure to politely, but firmly, decline to answer questions about alcohol consumption. You can also calmly refuse a breathalyzer test. (This is legal in Georgia. While it may cost you a driver’s license, it may help your defense later on.) The most important thing is to avoid saying too much or escalating the situation with the officer.

Call a lawyer immediately.

Even over the holidays, we recommend that you call our office immediately after an arrest. If your license is suspended, you have just 30 days to appeal that charge, so it is a good idea to get started with a legal team as soon as you can.

Keep your holiday plans.

Even if you were arrested for a DUI, you can still enjoy the holidays with friends and family this year. Yes, even if you face a DUI conviction. There are often ways that your attorney can help you get your sentence reduced or evidence challenged in court.

If you have been arrested in Georgia this holiday season, let our office help!

As always we recommend you use a car service or have a reliable designated driver to avoid being on the roads in any altered state of mind. Please stay safe this holiday season!
