At Schiavone Law, we are looking forward to a wonderful celebration this month with the friends and family we hold dear. But while this time can be refreshing, fun and filled with gratitude, it can also be dangerous. Thanksgiving weekend is traditionally the busiest travel weekend of the year.

With more cars on the road, the risk of accidents, DUI arrests and police checkpoints go up significantly. In 2010, from Thanksgiving to New Year’s Day, traffic fatalities that involved an impaired driver rose 34% from the rest of the year. And the Wednesday before Thanksgiving is often referred to as “Black Wednesday Thanksgiving” because it is a popular bar night and a high traffic time.

Obey the Law, But Know Your Rights

So, we have some suggestions on how to navigate this festive holiday season:

  1. This might be a given, but do not drive after drinking. Even one drink can raise your Blood Alcohol Level above the legal limit. There are so many other options this time of year – companies like Uber and Lyft, a taxi, all the family in town. With an increased police presence on the road this time of year, you are much more likely to get stopped and caught for driving under the influence.
  1. If you are stopped or get in an accident while under the influence, try to stay calm and cooperative. But remember that you can (and should) utilize your right to remain silent and consult with a lawyer before you say anything to police. Contact a DUI lawyer as soon as you can. They will need to get started on your case as early in the process as possible.
