Criminal Caselaw Update at 2025 ICJE Judicial Conference

On May 16, 2025, Ashley Schiavone was honored to speak at the bi-annual Municipal Court Judge’s Conference (ICJE, Institute for Continuing Judicial Education) in Jekyll Island Georgia.  This conference includes Municipal and Recorder’s Court judges throughout the State of Georgia.  Drawing from her continuous attention to growing DUI and traffic caselaw, Ashley presented an hour-long update on criminal caselaw update.  She reviewed cases from our United States Supreme Court, Georgia Supreme Court and Georgia Court of Appeals that have handed down decisions in both 2024 and 2025.  In the area of DUI and traffic, Ashley touched on different areas that have sparked attention in the past year including search and seizure issues, statute of limitations and COVID consequences, blood drawing and search warrant implications, and consent or refusal to state chemical testing.  Ashley also touched on other areas of criminal law that have seen new caselaw emerge in 2024 and 2025.  Her review of criminal law in general explored new cases that have handed down decisions in areas of constitutional consideration (Due Process, Confrontation Clause Rights and Equal Protection), legal advocacy, legal procedure, search and seizure, jurisdiction, witnesses, evidence, juries, sentencing and post-conviction relief. It was an interactive hour where judges were encouraged to ask questions, share personal courtroom experiences and reflect collectively on the important cases that have made an impact in our State.
